The Global Vape Regulation Map 2026: Five Major Markets at a Glance
Published · Updated · 4 min read
Our original version of this piece compared five markets. Since then, this series has covered close to twenty — this update rebuilds the map at that scale, organized by regulatory posture rather than region, so it works as a genuine starting point for evaluating any new market.
Fully regulated markets — legal, with real variation in the details
| Market | Nicotine cap | Device-form test | Tax structure |
|---|---|---|---|
| US | No federal cap | None federally | None federally (PACT Act governs shipping, not tax) |
| EU | 20mg/ml (TPD) | Battery-removable, from Feb 2027 | Varies by member state |
| UK | No hard cap noted | Non-rechargeable disposables banned | Specific: £2.20/10ml |
| Canada | 20mg/ml | None federally | Varies by province |
| New Zealand | 28.5mg/ml | Battery-removable, already in force | — |
| South Korea | — | — | Specific, synthetic nicotine now included |
| UAE / Saudi Arabia | — | — | Ad valorem, 100% |
| Poland (within EU) | 20mg/ml (TPD floor) | — | Specific, +75% since last increase |
| Philippines | — | Open-system restricted, closed-system unaffected | Specific, ₱60.20/ml |
| South Africa | — | — | Specific, per-ml (bill pending would add more) |
Prescription or medicalized markets — legal, but not as a consumer good
| Market | Model |
|---|---|
| Australia | Nicotine vapes classified as therapeutic goods; disposables banned outright; only refillable systems permitted, pharmacy-only |
Fully banned markets — no compliant pathway exists
| Market | Notable detail |
|---|---|
| India | Full chain ban (PECA) since 2019; no signs of easing |
| Mexico | Full ban since January 2026, now constitutionally entrenched |
| Brazil | Banned since 2009, upheld again in 2026 |
| Argentina, Uruguay, Suriname, Venezuela | Full bans |
| Thailand | Criminal penalties, record 2026 enforcement |
| Singapore | Full ban, strict enforcement |
| Japan | Not a device ban — nicotine e-liquid classified as pharmaceutical, blocking legal sale in practice |
Transitioning markets — legal today, direction already set
| Market | What's coming |
|---|---|
| Ireland | Disposable ban bill already sent to the president for signature |
| South Africa | TPEDSC Bill would add flavor bans, disposable restrictions, steep penalties |
| Spain | Draft flavor ban complete, awaiting a vote |
| Israel | Proposed disposable + flavor ban, mandatory black devices from Sept 2026 |
| EU (TPD3, region-wide) | Consultation closed Aug 2026; full effect unlikely before 2028 |
China: a special case worth flagging separately
China doesn't fit any of the categories above cleanly, because the relevant question isn't "is it legal" but "which standard applies." Domestic sales face tobacco-flavor-only, closed-system-only, tobacco-derived-nicotine-only rules since October 2022. Export product follows the destination market's own standard instead — meaning China's strict domestic rules generally don't constrain what can be manufactured there for a market like the US or EU. This asymmetry is worth understanding on its own, covered in full in our China domestic standards piece.
Two variables worth checking in every market, regardless of category
Two dimensions recur across nearly every piece in this series and deserve to be checked as standing habits, not one-off details:
- Nicotine source (synthetic vs. tobacco-derived) — South Korea has already folded synthetic nicotine into full tobacco regulation; the US requires separate authorization for it. Any market whose nicotine law text says "tobacco-derived" is a reasonable bet to eventually get amended the same way.
- Adjacent categories (especially nicotine pouches) — several markets regulate pouches far more loosely than vapes today, and disposable bans are visibly pushing demand toward them. That gap is real but time-limited; the EU's TPD3 would close it by around 2028.
How to actually use this map
This table is a starting point, not a finish line. For any specific market, run it through the full eight-question checklist — nicotine source and cap, device-form test, flavor naming rules, tax structure, national vs. regional fragmentation, logistics/customs exposure, and trend direction — before committing sourcing decisions. The individual country and framework pieces linked throughout this series go deeper on each of these than this summary table can.
